A groundbreaking collaboration was formed between the Kenya Judiciary Academy (KJA) and the Chartered Institute of Arbitrators Kenya Branch (CIArb Kenya), aimed at advancing the practice and application of Alternative Dispute Resolution (ADR) mechanisms in Kenya’s justice system.
The Memorandum of Understanding (MOU) was officially signed during the Nairobi Arbitration Week on Thursday, 20th March 2025, marking a significant milestone in the journey towards improving access to justice and enhancing the efficiency of dispute resolution in the country.
Key Objectives of the Collaboration:
The partnership between KJA and CIArb Kenya will focus on the following core objectives:
- Promoting ADR Mechanisms: A strong emphasis on Arbitration, Mediation, Conciliation, and Construction Adjudication as effective tools for dispute resolution.
- Judicial Capacity Building: Offering comprehensive training, education, and capacity-building initiatives to judicial officers and staff to enhance their expertise in ADR.
- Legal Reforms & Advocacy: Supporting legislative changes to improve ADR frameworks and ensure that Kenya remains a leading hub for arbitration and ADR.
- Research & Knowledge Sharing: Facilitating joint research initiatives to better understand the integration of ADR and the courts, and fostering collaboration between judicial officers and ADR professionals.
Joint Initiatives:
Both organizations are committed to coordinating several impactful initiatives, including:
- Development of educational materials and guidelines for ADR.
- Joint seminars, conferences, and workshops to promote ADR awareness and enhance skills.
- Co-authorship of publications on best practices and recent trends in ADR.
- Research collaborations aimed at improving the synergy between ADR and the judicial process in Kenya.
Role of KJA:
As Kenya’s premier judicial training institution, KJA will lead efforts in providing training, conducting public awareness campaigns, and supporting legal reforms that facilitate the growth of ADR in the country.
Role of CIArb Kenya:
CIArb Kenya will spearhead the certification and professional development of judicial officers, ensuring that they are equipped with the necessary skills and knowledge to implement ADR effectively in their respective fields.
