The Chartered Institute of Arbitrators (Ciarb) Kenya Branch invites eligible members to enroll in Module 3: Decision Making in Construction Adjudication—the final stage of the Construction Adjudication pathway before progression towards Fellowship (FCIArb).

This advanced module equips participants with the practical knowledge and decision-writing skills required to evaluate evidence, analyze legal submissions, and produce well-reasoned, enforceable adjudication decisions in accordance with the Housing Grants, Construction and Regeneration Act 1996.

Designed for practicing adjudicators and ADR professionals, the programme combines expert-led tutorials with a rigorous assessment focused on real-world construction disputes.

About the Course

Construction adjudicators are expected to make fair, logical, and enforceable decisions within strict timelines. This module develops the analytical and practical skills required to perform that role confidently.

Throughout the programme, participants will learn how to:

• Identify and define the issues in dispute
• Analyze parties’ submissions
• Evaluate documentary and witness evidence
• Apply legal principles correctly
• Structure logical reasoning
• Draft clear, reasoned, and enforceable adjudication decisions

The programme is delivered through three interactive tutorials, supported by a comprehensive workbook and guided discussions led by experienced practitioners.

Entry Requirements

Applicants must have:

• Successfully completed Module 1 – Law, Practice and Procedure of Adjudication under the New Pathways Programme.
• Successfully completed Module 2 – Law of Obligations under the New Pathways Programme or Module 1 under the previous pathway.
• Or obtained an exemption from Module 2 through the Ciarb exemption process.

Learning Outcomes

Upon successful completion, participants will be able to:

• Evaluate and assess evidence effectively.
• Identify and organize issues arising from parties’ submissions.
• Apply legal principles logically to the facts.
• Produce clear, structured, and enforceable adjudication decisions.
• Draft both the reasoning and operative sections of an adjudicator’s decision.
• Address costs, interest, and other procedural matters appropriately.

Assessment

Assessment is through a four-hour Decision Writing Examination.

To successfully complete the module, candidates must achieve a minimum overall mark of 70%.

Successful candidates will:

• Receive the Ciarb Advanced Certificate in Construction Adjudication
• Become eligible to undertake the Peer Interview as part of the progression to Fellow (FCIArb) status

Participants may pay in installments:

• First installment: KSh 30,000 by 14th August 2026
• Balance: Payable by 22nd September 2026

The examination fee is payable separately to the NCBA GBP Account.

Installment payments are accepted, provided the full amount is paid by 22nd October 2026.
