Advance Your Arbitration Practice Through Award Writing

The Module 3 – Award Writing programme is designed for arbitration practitioners who wish to develop advanced practical skills in analysing evidence, determining issues in dispute, evaluating submissions, and preparing clear, reasoned and enforceable Arbitration Awards.

The programme runs for approximately three months, comprising online tutorials, practical exercises and a final written examination.

Who Is This Course For?

This course is suitable for:

• Current Members of the Chartered Institute of Arbitrators (MCIArb).
• Practitioners seeking to deepen their knowledge and practical skills in arbitration award writing.
• Party representatives, in-house counsel, advocates and dispute resolution practitioners.
• Candidates intending to progress towards Fellow (FCIArb) status.

Entry Requirements

Candidates must have met one of the following requirements:

• Successfully completed and passed Ciarb Module 1 – Law, Practice and Procedure under the New Pathways Programme; or
• Successfully completed the Special Process & Procedure Transition; or
• Successfully completed and passed Ciarb Module 2 – Law of Obligations under the New Pathways Programme or Module 1 under the Old Pathways; or
• Been granted an exemption from Module 2 after successfully passing the exemption assessment.

Upon successful completion of the programme, candidates will be able to:

• Recognise and evaluate different forms of evidence.
• Identify and analyse issues arising from parties’ submissions.
• Structure Arbitration Awards logically and effectively.
• Apply the relevant law to the facts and determine disputes.
• Draft clear, reasoned and enforceable Arbitration Awards.
• Distinguish between the discursive and operative sections of an Award.
• Address costs, interest, arbitrator’s fees and expenses.
• Ensure that Awards comply with applicable legal requirements for enforceability.

The programme covers:

• Basic concepts and types of evidence
• Burden and standard of proof
• Hearsay
• Privilege
• Written evidence and document disclosure
• Witness evidence
• Expert evidence

Award Writing

Participants will explore:

• Purpose and function of an Arbitration Award
• Plain-language drafting
• Legal and substantive requirements
• Identifying issues for determination
• Decision-making and reasoning
• Structure and format of an Award
• Publishing the Award
• Costs and interest

Practical Learning

The programme combines online lectures, discussions and practical exercises designed to develop the skills required to prepare a well-structured and properly reasoned Arbitration Award.

A comprehensive workbook will be issued upon confirmation of registration and payment in accordance with the Branch’s procedures.

Assessment

The programme culminates in a four-hour Award Writing Examination.

Candidates must achieve a minimum overall mark of 70% to pass.

Successful candidates will:

• Receive an Advanced Certificate.
• Become eligible to apply for the Peer Interview as part of the progression towards Fellow (FCIArb) status.

Instalment Payment

Participants may pay the tutorial fee in instalments, provided the full course fee is cleared on or before 20 October 2026.

Examination Fee

The examination fee may also be paid in instalments, provided the full examination fee is paid on or before 10 November 2026.

Important Information

• Participants must have regularised their Ciarb membership before registering.
• The examination will be based on the Arbitration Act 1995.
• Tutorial and examination fees may be paid by instalments, subject to the applicable deadlines.
• Participants paying by instalments should contact the Branch Accounts Office for payment arrangements.
• Course materials will be available for collection from the CIArb Kenya Branch office or may be delivered at the participant’s cost after payment of the course fees.
• Participants are expected to have copies of the relevant legislation and any prescribed reading materials communicated before the programme begins.

Deferment
