CIArb Kenya Chairman moderated a session comprising of Fellows of Chartered Institute of Arbitrators (CIArb) from Zambia and Kenya, all decorated experts in Construction Law.
Eng. Henry Musonda started us off highlighting the importance of early engagement with the DB to build collaborative relationships. He emphasized leveraging the DB for informal dispute resolution, presenting strategies for effective communication and thorough documentation to preemptively address potential conflicts.
QS Kauzya Siwale addressed the escalation of disputes into formal proceedings detailing the process for initiating formal DB proceedings and managing the DB hearing process. He also covered the essential aspects of understanding and responding to DB recommendations, offering guidance on how to navigate formal dispute resolution when initial avoidance measures prove insufficient.
Eng.Daniel Cherono explored the implications of DB recommendations in terms of legal consequences and enforcement strategies. He provided insights into the strategies for enforcing DB decisions effectively and further illustrated both successful and unsuccessful implementations of DB recommendations, providing delegates valuable lessons for future reference
